The convention was organized in collaboration with The Federalist\nSociety for Law and Public Policy Studies, a group of conservatives and libertarians\ninterested in the current state of the legal order and iJustice, a public\ninterest legal advocacy initiative of the Centre for Civil Society (CCS) aiming\nat advancing laws promoting personal, social and economic liberties, and at the\nsame time imposing limits on the powers exercised by the state, through\nstrategic litigation and legal advocacy.<\/p>\n\n\n\n<p>The forum on \u2018Law and\nliberty\u2019, had multiple tracks addressing a host of legal issues around Liberty\nvs Equality, License-Permit Raj to Competition Era, Separation of\nPowers\u2013Judicial Activism, Usurping Executive Powers, Individual Rights vs\nMinority Rights and Right to Property. Over sixteen eminent speakers, both from\nIndia and abroad presented at the two day conference.&nbsp; <\/p>\n\n\n\n<p>\u201cIt is not very often, that\none gets to see the word, \u2018liberty\u2019 appear beside, \u2018law\u2019,\u201d said, Dr. Parth J.\nShah, President, Centre for Civil Society, Delhi, while deliberating on the\noxymoron that existed in the name of the International conference on \u2018Law and\nLiberty\u2019. Delivering his opening remarks at the conference, Dr. Shah, further\nexamined the history of the concept of liberty in the democratic system of\ngovernance, and said, \u201cAround the world, liberty, equality, justice and\nfraternity are known to be the cornerstones of any constitutional framework,\nwith liberty taking precedence each time.\u201d <\/p>\n\n\n\n<p>Delivering the inaugural\naddress at the conference Professor (Dr.) C. Raj Kumar, Vice Chancellor, O.P.\nJindal Global University (JGU), spoke of the ideological challenges pertaining\nto law and liberty in the country, he said, \u201cIn India particularly, we are\nliving in the 19<sup>th<\/sup>, 20<sup>th<\/sup> and the 21<sup>st<\/sup> century\ntogether, and in a situation where you are living three centuries together, you\nsimultaneously experience a form of political and constitutional discourse for\nwhich ideology alone does not suffice, and hence arises a need to develop a\nmore nuanced understanding of issues\u201d. Stressing on the critical need for the\nlegal system to assume a larger role in the political and social discourse of\nthe country, he stated, \u201cAs lawyers and public policy academics, one of the big\nchallenges for many of us today, is to look at how law can actually be relevant\nto the larger political and social discourse that is taking place, we need to\ndevelop a deeper understanding of issues relating to law and liberty and we\nmust have a contemporary view of these issues, I am certain that this\nconference will help address some of the fundamental and underlying issues\nrelated to law and liberty\u201d <\/p>\n\n\n\n<p>Speaking on\nconstitutionalism in emerging states and the challenges faced by emerging\ndemocracies, Prof. Michael Davis, Distinguished Visiting Professor, JGLS &amp;\nProfessor, Faculty of Law, The University of Hong Kong, said,\n\u201cConstitutionalism is not just about development of institutions, constitutions\nare not just words on paper endowed with original intent, rather they are\navenues for interaction and mutual consent of the core institutions of\ngovernment\u201d. Debating if the process of constitutional judicial review actually\nserves the purpose of constitutionalism, he said, \u201cScholars have long\nappreciated that, constitutional judicial review, not only constraints but\nlegitimates government undertakings, while simultaneously empowering people and\nin many cases functioning as a guardian of core institutions. <\/p>\n\n\n\n<p>Speaking on the \u2018State\u2019s\nright to exercise eminent domain\u2019 and \u2018how the difference in the public opinion\ninfluences the judiciary to take discourses from its past judgments\u2019. Prof.\nJames Huffman, Erskine Wood Sr. Professor of Law, Lewis and Clarke Law School,\nsaid, \u201cThe main purpose or objective of the state to use eminent domain is to\nensure equal generation of wealth in the society by equal distribution of\nnatural resources to the people. But once the main objective becomes\nfar-fetched or impossible to accomplish, there is no point of exercising such\nan arbitrary right.\u201d<\/p>\n\n\n\n<p>The International conference\non \u2018Law and Liberty\u2019 included perspectives from several other speakers. Shruti\nRajgopalan, Asst. Prof, Economics, Purchase College, State University of New\nYork, spoke about the concept of Socialism vs. Constitutionalism in India, and\nSeparation of Powers, where she underlined the four key aspects of judicial\noverreach namely, legislative, constitutional, executive and self\n-adjudicating.
