The Centre submitted comments to the Ministry of Electronics and Information Technology (MeitY) on the draft Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Second Amendment Rules, 2026. The submission welcomes the Government’s efforts to address emerging challenges posed by synthetic media, platform governance, and intermediary accountability. At the same time, it emphasises the importance of ensuring that regulatory interventions remain constitutionally sound, proportionate, and aligned with established principles of administrative law. Drawing on comparative approaches from the European Union, the United Kingdom, China, and the United States, the submission seeks to contribute constructively to the development of a regulatory framework that is constitutionally robust, technologically informed, and aligned with international best practices.
